Personal Data Processing Policy for Job Applicants

T-Mobile Czech Republic a.s., with its registered office at Tomíčkova 2144/1, 148 00 Prague 4, ID No. 64949681, registered in the Commercial Register maintained by the Municipal Court in Prague, file no. B 3787 as the personal data controller (hereinafter referred to as "T-Mobile") has adopted this Personal Data Processing Policy for Job Applicants (hereinafter referred to as the “Policy”). The purpose of this Policy is to inform you, as a job applicant, about the manner and extent of the personal data processing and about the rights to which you are entitled.

We always process your personal data transparently, fairly, and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”) and Act No. 110/2019 Coll., on the processing of personal data, to the extent necessary for the respective purpose. To this end, we have adopted appropriate security measures. We retain personal data for the period strictly necessary in accordance with the retention periods imposed on us by law.

  1. Types of Personal Data Processed

When you apply for our selection procedure, we process the following data about you:

  1. Identification and contact data:Name and surname, title, permanent residence address, temporary residence address, private email address, telephone number.
  2. Other personal data:This includes data you provide about yourself in the documents you send us, e.g., in a cover letter, your curriculum vitae (CV), or a motivation letter. The provision of this data is voluntary.
  3. Data on education and previous employment:Data on your education (e.g., list of completed schools, diplomas, certificates, completed courses), language skills, your skills, information about previous employment, driving licence, and other data you provide in your CV and motivation letter.
  4. Publicly available data:Information that is available on the internet, e.g., information listed in the Commercial Register, the insolvency register, or other legally permitted databases, if relevant. To a justified extent, international sanction and control lists or other sources may also be used, but always only to the necessary extent with regard to the given position. Furthermore, we are entitled to view your publicly available data on the social network LinkedIn.
  5. Data from our communication:This mainly includes our notes from telephone calls, notes from personal interviews (including online interviews), or our mutual written communication related to the given selection procedure. A recording of the interview may also be made for the purposes of the selection procedure – however, always exclusively with your knowledge and consent to the making of the recording and its further related processing, particularly its transcription and summarisation.
  6. Eligibility for the given position:You may be required to prove that you are legally eligible for the given position, e.g., through education, language skills, or that you are medically fit for selected types of positions.
  7. Declaration of a clean criminal record:Depending on the nature of the job position, we may ask you to submit a declaration confirming that you have not been convicted of any crime or misdemeanour (a current extract from the criminal record).
  8. CCTV footage:Our premises may be equipped with a CCTV system, which is clearly marked. The reason for the installation of the CCTV system is to ensure the protection of the rights and legally protected interests of our company and to ensure the safety of our employees, customers, and other persons entering our premises. A job applicant is always informed about the operation of the CCTV system by information signs at the entrance to the monitored area.

In addition, depending on the position you are applying for, we may also obtain information from the following sources:

  • Internal applications:If you already work for T-Mobile and are applying for an internal position, we may use information from your personnel file to supplement the information you provide in your job application.
  • Assessments:We may ask you to undergo an assessment of your skills, personality, or cognitive abilities. Such assessments are usually carried out using third-party software or through a third-party company that shares the results with us. Before such an assessment is carried out, we will provide you with further information regarding your specific situation.
  • References:We may decide to obtain references from persons who have worked with you in the past. We will only contact these persons if you provide us with their names and contact details. If you are already an employee of T-Mobile, we may request references from your manager and/or colleagues.

Personal data processed in the event of your success in the selection procedure

If you succeed in the selection process and we select you for the position in question, in addition to the data mentioned above, we are entitled, on the legal basis of performance of a contract (i.e., pre-contractual relations), to also obtain the following information from you:

  • Personal details: for example, date of birth, birth surname, ID card number or other identity document number, personal identification number (rodné číslo), marital status, nationality, photograph, work permit, Social Insurance Agency identification number.
  • Information about family members and dependants: e.g., name, surname, title, date of birth of a spouse or partner; name, surname, title, date of birth, personal identification number of your children.
  • Information concerning remuneration, pension security, health security, and other benefits: e.g., name of the health insurance company, pension insurance, supplementary pension savings, bank name and account number, wage deductions.
  • Information from an employment reference (references from persons with whom you have worked in the past) and a certificate of employment.

We will process special categories of personal data only for purposes strictly related to the proper performance of our duties as your future employer, and only to the necessary extent required by the relevant legal regulations.

We will process the following types of sensitive personal data:

  • Data concerning your health: for example, a certificate of disability and health impairment of an employee, results of a preventive medical examination in relation to work, data on psychological and physical fitness for work.
  • Extract from the criminal record: for selected job positions such as work with entrusted funds, cash, etc.
  1. Legal Title and Purpose of Data Processing

Processing of personal data without your consent:

  1. Legitimate interest: our legitimate interest lies in the selection of the most suitable candidate for the vacant position to be filled.
  2. Performance of the contract (conclusion of the contract): in the event of your success in the selection procedure, we are entitled to process your personal data on the basis of a pre-contractual relationship.
  3. Compliance with legal obligations: we are entitled to process your personal data to comply with obligations arising from the relevant legal regulations.

T-Mobile informs you that in order to streamline the recruitment process of new employees, it processes your personal data for statistical purposes. The result is completely anonymized analyses.

Processing of personal data based on your consent:

We process personal data with your consent to the processing of personal data for the purpose of offering other vacancies. As a job seeker, you have the option of granting consent to inclusion in the database at the same time to T-Mobile's partner company, Slovak Telekom, a.s.   • If you decide to subscribe to our newsletters, we process your e-mail address. T-Mobile sends Newsletters in the area of other career opportunities, i.e. employment at T-Mobile and news in the field of HR.

T-Mobile will process your data for the following purposes:

  1. Recruitment: We process your data to determine if you are a qualified candidate for the position you are applying for.
  2. Resolve any disputes: We may process personal data for the purpose of resolving disputes, complaints or legal processes.
  3. Sending HR Newsletters: We also process your e-mail address if you register for our Newsletters. T-Mobile sends Newsletters in the area of other career opportunities, i.e. employment at T-Mobile and news in the field of HR. You can unsubscribe from the Newsletter at any time by clicking on the link we send in each Newsletter or at the e-mail address: zamestnani@t-mobile.cz.
  1. Recipients and processors of your personal data

Your personal data is processed in particular by authorized employees of T-Mobile, only to the extent necessary in the given case and in compliance with all security measures (including the obligation of confidentiality).

T-Mobile is entitled to share your data in the following cases:

  • If we obtain information from third parties (as described above), we will provide them with your name and any other information necessary to provide us with relevant information about you.
  • We may share your personal data with our contractual partners who act on our behalf, for example with a service provider(so-called processors or recipients). In such cases,these third parties may only  useyourpersonalinformation for the purposes described above and only in accordance with our instructions. In the event that your personal data is processed by processors, we always conclude an appropriate personal data processing agreement with each processor. An important processor is LMC, s.r.o., Company ID No.: 26441381, with its registered office at Jankovcova 1569/2c, Prague 7, Postal Code: 170 00 or SCAUT, s.r.o., Company ID No.: 09296182, with its registered office at Innowacjí 122, 252 41 Zlatníky Hodkovice.
  • For the purposes of data processing, T-Mobile uses the software tools of its business partner, recruitis.io s.r.o. However, the contractual partner does not have access to your personal data.
  • Where required by applicable law or court order, we may share your personal information, for example, with law enforcement or other authorized authorities.
  • In the event of a legitimate interest, we may provide your personal data to companies with economic or personal connections, but always only if there is a reason for such disclosure.
  1. Place of processing of your personal data

The place of processing of your personal data is primarily the Czech Republic or other countries of the European Union. In the case of processing outside the European Union, this will take place exclusively to the extent necessary and under strict security standards and compliance with all legal regulations, in particular on the basis of an adequacy decision of the European Commission (Article 45 of the GDPR) or the adoption of appropriate guarantees under Article 46 of the GDPR.

  1. Period of personal data processing

We keep your personal data for a limited period of time. We process your personal data on the basis of a legitimate interest for the duration of the selection procedure for the position to be filled. Your data will be deleted as soon as it is no longer required for the purpose of the processing. This means that we will store your data for the duration of the selection process in which we became acquainted with your personal data. The reason for this retention is to protect our interests in the event of dispute resolution. If we select you to fill the position, we will store your personal data in a personal file, in accordance with our HR privacy policies.

We may process your personal data for a longer period after the end of the selection process, in the event of a potential legal dispute.

If you give us your consent to be included in the database of job seekers, we process your personal data for a period of 2 years from the granting of consent. You can withdraw your consent at any time. In this case, your personal data will be deleted.

In the event of your entry into the T-Mobile premises, for example, for the purpose of holding a personal interview, a camera recording may be made in the designated areas. We keep camera recordings for 1 month.

If at any time you decide to withdraw from the selection process before it has been completed by T-Mobile, you may do so and freely delete your personal data via the following address: https://app.recruitis.io/public/unsubscribe.

Right of access to personal data

Simply put, you have the right to know what data we process about you, for what purpose, for how long, where we collect your personal data and what other rights you have related to the processing of your personal data. As part of your right of access, you can ask us for a copy of the personal data you process. Your personal data will usually be provided to you in writing, unless otherwise requested or if you have requested it by electronic means, the information will be provided to you electronically if possible.

Right to rectification

If you find that the personal data we process about you is inaccurate or incomplete, you have the right to have it corrected or supplemented without undue delay.

Right to erasure of personal data ("right to be forgotten")

In certain circumstances, you have the right to ask us to delete your personal data, for example when the personal data we collected is no longer needed for the original purpose or when you withdraw your consent. Please note that even if this is one of these reasons, it does not mean that we will delete all of your personal data immediately. This right does not apply if the processing of your personal data is still necessary for e.g. the fulfilment of legal obligations or the establishment, exercise or defence of our legal claims.

Right to restriction of processing

This is the right to request the restriction of the processing of your personal data in the event of reasons defined by legal regulations (e.g. due to the inaccuracy of the processed personal data or the illegality of their processing, or to raise an objection in the case of the processing of your personal data on the basis of a legitimate interest).

Right to data portability (portability)

In certain circumstances, you have the right to ask us to transfer personal data that you have provided to us to another third party.

Right to object to processing

You have the right to object to the processing of personal data that takes place on the basis of our legitimate interest. In such a case, we will no longer process your personal data for the purpose in question, unless we have compelling legitimate grounds to continue such processing, including to defend our legal claims.

The right not to be subject to purely automated decision-making

You have the right not to be subject to automated decision-making, including profiling, with legal or similar effects.

Right to withdraw consent to the processing of personal data

If you give us your consent to process your personal data for inclusion in our database of job seekers, you can withdraw this consent at any time. In such a case, T-Mobile will cease to process your personal data without undue delay.

Right to lodge a complaint with the Office for Personal Data Protection

Your right to lodge a complaint with a supervisory authority. You have the right to address your complaint to: Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, 170 00 Prague 7, Czech Republic.
